The thesis of the negative case is that the United States ought not guarantee the right to housing, because housing is a positive right that infringes on negative rights.

Since housing is not free, it is not a right in the United States. Freedom, the right to vote, and the right to not be discriminated against are all self-evident rights that cannot be purchased. Housing must be obtained through an exchange of goods, and therefore is a positive right. This positive right infringes upon the negative rights of taxpayers, insofar as their negative right to freedom is infringed upon by unjust taxation.
Additionally, to call housing a right necessarily means that it must be judicially enforced. The Late Justice Byron White writes,

Punishing homelessness by judicially targeting homeless persons or the systems that create homelessness is either impossible or grossly immoral. The United States ought to work towards decreasing homelessness without criminalizing it. Calling housing a right criminalizes homelessness, and therefore cannot be properly considered a right. At best, it is a positive right that people are not entitled to and infringes upon negative rights via taxation.
