Ignore framework justifications that don’t speak to the actor. And, the government is util. 2 reasons. First is Actor obligations. A. Policy-making must be ends-based since side constraints make it impossible to weigh the tradeoffs inherent to decisions involving opportunity costs, as some constraint will always be violated. Even if there exists a way to differentiate violations, when these methods conflict, there exists no way to differentiate between them- any possible method without appealing to a higher set of principles, leading to infinite regress. Thus, there is no act-omission distinction for governments. B. Government's ontology is based on survival. Ogbunwzeh, C. Public policy-makers must look at util first because they act on behalf of a collective body, Goodin, Second is Policy making A. Judges have an obligation to endorse the most educational practices.
