Util NegTournament: Damus | Round: 1 | Opponent: idk | Judge: idk My value is Utilitarianism – the greatest good for the greatest number of people. Prefer my standard:1. Utility is the most educational framework because it mirrors the decision of policy makers. This allows us to engage in policy-making role-playing, which is the most portable educational skill.2. Public policy-makers must look at the utilitarianism first because they act on behalf of a collective body.Goodin 1995 ~Robert E. Goodin. Philosopher of Political Theory, Public Policy, and Applied Ethics. Utilitarianism as a Public Philosophy. Cambridge University Press, 1995. p. 26-7~ 3. Utilitarianism is best for education because it focuses on empirical research and comparison – those skills are essential for critical thinkingShaw 1999 - Chair of the Philosophy Department at San Jose State University ~William H., Contemporary Ethics: Taking Account of Utilitarianism. p. 171-2. 4. All values collapse into utilitarianism or tautologyGreen, 2002 – Assistant Professor Department of Psychology Harvard University (Joshua, November 2002 "The Terrible, Horrible, No Good, Very Bad Truth About Morality And What To Do About It", 314) 1. Qualified Immunity is necessary for law enforcement – it prevents over deterrence and allows police to focus on their jobsRosen 2005 - Prof of law, University of San Diego ~Michael M. Golden Gate University Law Review Volume 35 | Issue 2 January "A Qualified Defense: In Support of the Doctrine of Qualified Immunity in Excessive Force Cases, With Some Suggestions for its Improvement" http://digitalcommons.law.ggu.edu/ggulrev Part of the Criminal Law Commons~ 2. Qualified immunity doesn't allow unreasonable behavior – it simply helps define what reasonable behavior is.Rosen 2005 - Prof of law, University of San Diego ~Michael M. Golden Gate University Law Review Volume 35 | Issue 2 January "A Qualified Defense: In Support of the Doctrine of Qualified Immunity in Excessive Force Cases, With Some Suggestions for its Improvement" http://digitalcommons.law.ggu.edu/ggulrev Part of the Criminal Law Commons~ 3. Qualified Immunity prevents court clog because it dismisses cases before they go to trial.Putnam, 1992 - Senior Assistant Attorney General, Office of the New Hampshire Attorney General, ~Charles T Bridgeport Law Review, Quinnipiac College, Spring 1992, Volume 12, Number 3 "Defending A Maligned Defense: The Policy Bases Of The Qualified Immunity Defense In Actions Under 42 U.S.C. § 1983"~ 4. Qualified immunity is necessary to prevent – frivolous lawsuits deter the police from doing their job and waste their time in court.Rosen 2005 - Prof of law, University of San Diego ~Michael M. 5. Even if police do not personally pay the fines for lawsuits, they would still be deterred by the substantial impacts that lawsuits can have on them.Rosen 2005 - Prof of law, University of San Diego ~Michael M. Golden Gate University Law Review Volume 35 | Issue 2 January "A Qualified Defense: In Support of the Doctrine of Qualified Immunity in Excessive Force Cases, With Some Suggestions for its Improvement" http://digitalcommons.law.ggu.edu/ggulrev Part of the Criminal Law Commons~ Contention Two – There are better Alternatives like cameras, training and civilian review happening right now to solve Police ViolenceMarcus, 2015 – prof of constitutional law at Indiana Tech ~Nancy Howard Law Journal Fall, 59 How. L.J. 5 Out of Breath and Down to the Wire: A Call for Constitution-Focused Police Reform Lexis~ Subpoint One: Cameras – Body cameras help to discipline officers who commit violence and prove innocent officers who are wrongly accused. Their superiors will efficiently be able to see what police officers are doing on a daily basis, and if they see some unusual activity, they can address the issue before it becomes a much bigger violation of human rights. Officers would be deterred from abusing constitutional rights if they knew they were being watched. Cameras would be a much better alternative to eliminating qualified immunity because police would be held accountable for the crimes that they do commit, and not for the ones that they don't do.Subpoint Two: Training - Training is important because it teaches police how to deal with different situations. Training can prevent police from resorting to violence and abuse, because it can increase communication with suspects and other police. Police can be trained on de-escalating confrontations. They can learn how to deal with criminals in a more peaceful way rather than dominating the situation. Police can be trained in cultural sensitivity to eliminate their subconscious stereotypes of minority populations. Also, they can be trained to use non-lethal weapons, such as tasers. Those weapons are more effective because they do not kill people. Subpoint Three: Civilian Review - A better solution would be to shift the review boards out of the justice system and into a civilian review board. The reason that the community does not trust the review process now is because it is in the hands of the police – the people who are accused of the abuse. Taking the review out of the hands of the police and turning it over to a civilian review board would immediately tell the community that their voices were being heard. Many communities are establishing civilian review boards. | 11/6/16 |
