-====I negate the resolution "Resolved: Public colleges and universities in the United States ought not restrict any constitutionally protected speech."====
-
-
-===Framework===
-For the purpose of today’s round, I agree with my opponent’s definitions.
-I now offer the following framework for this round:
-
-
-==== ~~Value~~ I I value morality as implied by the word ought in the resolution and because a more desirable world is one that is more moral.====
-
-
-==== ~~Hossain 14~~ Hossain, from the Journal of Social Sciences, writes in 2014====
-~~Hossain, F.M.A. "Relation between Individual and Society." Relation between Individual and Society. Journal of Social Sciences, 13 Aug. 2014. Web. 07 Jan. 2016.~~
-Man is a social animal. Man needs society for his existence and survival.
-AND
-Thus, society and individuals are bound by an intimate and harmonious bond.
-
-
-==== ~~Value Criterion~~ Therefore, my value criterion is societal welfare. Societal welfare can be defined as the welfare of the society. It is necessary because the society shapes the individual, and without a well society, the individual cannot be well either.====
-Furthermore, I stipulate that as long as I can prove that any one form or type of speech is bad and harmful in the world of the affirmative, then we should negate the resolution.
-Therefore, I now offer my sole contention in support of a vote for the negative:
-
-
-===Contention 1 – Cyberbullying===
-
-
-====~~Harris and Ray 14~~ There are grey areas now – courts haven’t given enough guidance on internet speech, which leaves entry-level student affairs practitioners to decide for themselves. Harris and Ray, from Louisiana State University, write in 2014====
-~~Vincent T Harris has an M. Ed. degree and is a doctoral student @ LSU, Darrell C. Ray is a prof @ LSU, HATE SPEECH and THE COLLEGE CAMPUS: CONSIDERATIONS FOR ENTRY LEVEL STUDENT AFFAIRS PRACTITIONERS, Race, Gender and Class 21.1/2 (2014): 185-194. ProQuest.~~
-As universities expand curriculum offerings in the virtual realm an increasing amount of students will

-
-
-==== ~~Ambrose et al 12~~ Cyberbullying is bad – narrative evidence proves. Meg Ambrose from the University of Colorado, writes in 2012====
-~~Meg Leta Ambrose, doctoral candidate, Nicole Friess, JD, LLM, associate of Holland and Hart LLP, and Jill Van Matre, JD, associate director of University of Colorado’s ATLAS institute. "SEEKING DIGITAL REDEMPTION: THE FUTURE OF FORGIVENESS IN THE INTERNET AGE" 11/6/12~~
-Increasing aggregation and availability of information online means the past can be stirred with greater
-AND
-resentful one—whether technology is an impediment to the wellbeing of society.
-
-
-==== ~~DuMont 16~~ New anonymous social media companies open the floodgates for harassment. Susan DuMont, from the University of Maryland, writes in 2016====
-~~DuMont, Susan (DuMont has a J.D., from University of Maryland Francis King Carey School of Law, 2016; M.A., University of Delaware, 2010; B.A., Lake Forest College, 2007." Campus Safety v. Freedom of Speech: An Evaluation of University Responses to Problematic Speech on Anonymous Social Media", 11 J. Bus. and Tech. L. 239 (2016) http://digitalcommons.law.umaryland.edu/jbtl/vol11/iss2/7~~
-In the following decade, platforms like Twitter, Snapchat, LinkedIn, Instagram,
-AND
-in cross-examination. This causes psychological violence for students in college.
-
-
-==== ~~May 16~~ AND, Social media allows the harassment to continue, the Affirmative side’s commitment to free speech fails to question who benefits from free speech and denies the ability for colleges to make any meaningful reform. Emily May, from the Knight Foundation, writes in 2016====
-~~May, Emily. (May is co-founder and executive director of Hollaback!) "Knight Foundation." Knight Foundation. N.p., 5 July 2016. Web. 11 Jan. 2017. http://www.knightfoundation.org/articles/what-happens-when-corporations-are-put-charge-free-speech-online~~
-The internet is the new battleground over free speech—and the battle lines between
-AND
-whose interests lie with its shareholders first and foremost—truly value democracy?
-
-
-===Contention 2 – Plagiarism===
-
-
-====~~Duke 16~~ The affirmative protects college students’ acts of plagiarism when they turn in term papers produced by professionals selling them to students who turn them in as original work for academic credit. The Duke Law Journal writes,====
-~~Term papers prepared by professionals and sold to students, even though they are cut and dry examples of plagiarism, are constitutionally protected, Duke Law Journal: Term Paper Companies and the Constitution, 2016. Duke Law Journal 1275-1317 (2016) Available at: http://scholarship.law.duke.edu/dlj/vol22/iss6/3~~
-The preparation and sale of term papers involves not only written communication but also "
-AND
-the affirmative world, regardless of amendment, counterspeech, or good speech.
-
-
-==== ~~Colantuono 16~~ Plagiarism harms the academic environment in universities. Florence Colantuono furthers,====
-~~Florence Colantuono, "Academic Plagiarism." Explorable. 2016~~
-The written word is used to gauge a persons experience and achievement, when something is plagiarized it does not afford the reader a true opportunity to understand the writer, to gauge progress in academia. Clearly this act impacts the writers learning. If when presented with a paper an unknowing instructor provides constructive criticism that is meant for the writer to help improve, it is wasted. The author can never know the status of their work if it is not their own. Academic plagiarism affects many people along the way. It obviously affects the person whose work has been plagiarized by not affording the author credit for hard work. It affects the person who commits' the plagiarism by not affording the person an opportunity to receive constructive feedback. By not sharing ones own ideas important milestones are missed. It affects the efforts of the instructor to gauge the material being taught as useful of not. Generally academic plagiarism affects the academic community as a whole. Academic success is based on the ability of the institution to affect both public and corporate policy, with a high plagiarism rate the institution will lose standing and creditability.
-
-This turns the affirmative case and outweighs for multiple reasons:
-
-
-====First, of course, it is lying and stealing which is always morally wrong====
-Second, solving plagiarism must come before other reforms because the credibility of the college or university is key to shaping public policy, which means if speech on campuses is good, plagiarism prevents it from causing real change since it is no longer authentic
-Third, is scope, because if universities have no punishment for plagiarism, every
-AND
-the top 1 of our country where marginalized students can never actually succeed
-
-
-==== ~~Intelligence For Your Life 16~~ However, colleges are cracking down on plagiarism right now. Intelligence For Your Life writes in 2016====
-~~Intelligence For Your Life. "Schools Are Cracking Down on Cheating With High-Tech Devices." Intelligence For Your Life. Tesh.com, 01 Dec. 2016. Web. 23 Jan. 2017~~
-In schools across North America, the fight to stop cheating has gone high-
-AND
-this resolution, but now, let’s move on to my opponent’s case.
